Heard learned counsel for the petitioner as well as public
prosecutor and perused the material available on record.
The treatment report, prescription slip and ultra sonography
report of the wife of the petitioner shows follicles seen at
cervix. This is noted to be chronic healing cervicitis. It appears
that the said cyst is an old ailment, and, nowhere in the report,
the medical officer has suggested that immediate surgery is
required for the patient. It is noticed that on earlier occasions too,
on humanitarian ground, he was directed to be released on
temporary bail to look after ailment of his wife, which he availed
but nothing has been done for the cure of the ailment.
In the view of the matter, I am not inclined to release the
petitioner on bail. satisfying by the state that he is seeking
temporary bail on false pretext.

Hence the present bail application filed by the petitioner
Kehra Ram S/o Amra Ram is dimissed.
