                                                          ----Appellant-Plaintiff
                                   Versus
Ramesh Chandra Son Of Late Nand Kumar & Ors
                                               ----Respondents-Defendants

For Appellant(s) : Mr. Ajay Gupta For Respondent(s) :

HON'BLE MR. JUSTICE SUDESH BANSAL

Order

24/05/2022

Appellant-plaintiff has filed this first appeal against the

judgment and decree dated 11.04.2022 passed in Civil Suit

No.52/2007 (63/2013) (CIS No.72/2014) by the Court of

Additional District Judge No.2, Jhunjhunu.

It appears from the record that appellant-plaintiff filed a civil

suit claiming himself to be adopted son of Shri. Chore Lal and

Smt. Patasi Devi as also assailed the registered sale deed dated

06.04.1995 executed by Smt. Patasi Devi.

As far as, the adoption is concerned, the trial court decreed

the suit and declared plaintiff as adopted son but in relation to

assail the sale deed, the trial court observed that the property was

not ancestral, hence the plaintiff does not have any right in the

property, sold by his mother Smt. Patasi Devi.

Accordingly, the prayer for quashing the registered sale deed

dated 06.04.1995, has been declined and against this part of

judgment and decree, the first appeal has been preferred.

                                                             (2 of 2) [CFA-257/2022]

                                         Heard.

                                         Admit.

                                         Issue notice to respondents.

                                         Call for the record.

In the facts and circumstances of this appeal, this Court does

not find any good case to grant any ex-parte interim relief at this

stage.
