1. Petitioner has filed this third bail application under Section
439 Cr.P.C.
2. F.I.R. No.155/2019 was registered at Police Station
Budhadeet, District Kota for offence under Section 363 I.P.C.
3. It is contended by counsel for the petitioner that petitioner is
in custody for last one and a half year. There is no allegation of
rape against the present petitioner.
4. Learned Public Prosecutor has opposed the third bail
application.
5. I have considered the contentions.
6. From perusal of the record, it is revealed that there is
allegation against the petitioner of aiding the commission of
(2 of 2) [CRLMB-989/2022]
offence of rape. It is also evident that while rejecting the second
bail application, this Court observed that petitioner has criminal
antecedents pertaining to the POCSO Act, considering the same, I
am not inclined to entertain the third bail application.
7. Accordingly, present Criminal Misc. Third Bail Application is
dismissed.
