These writ petitions have been filed by the petitioners

challenging the action of the respondents of declaring them

ineligible for undergoing MBBS Course.

Taking into consideration the arguments advanced on behalf

of the parties, this Court vide orders dated 24.01.2022 and

25.01.2022 requested the AIIMS, Jodhpur to constitute a Medical

Board for the purpose of giving report regarding the so called

ineligibility suffered by the petitioners.

Report from the AIIMS, Jodhpur was submitted before this

Court on earlier occasions, however, considering the request of the

counsel for the petitioners, this Court vide order dated 02.03.2022

again directed the Medical Board, AIIMS to conduct a fresh

examination of the petitioners and thereafter to specify the

ineligibility suffered by them.

Pursuant to that Mr. Mukesh Rajpurohit, ASG has submitted

the medical report of the petitioners prepared by the Medical

Board, AIIMS and the opinion in respect of petitioner Aarti is given

as under :-

"On review examination by the Medical Board as per order of Hon'ble High Court dated 02.03.2022, ref.no. S.B. Civil Writ Petition No. 859/2022, the candidate under examination was examined and observed to have a Permanent Phy6sic al Impairment of 44%(forty four percent) in relation to left upper limb & lower limb which according to Gazette notification of India Part 3 Section IV (published 4 th Feb. 2019) appendix H S.No.1 Subsection a(f) makes the candidate "INELIGIBLE" as Both Hands with intact sensation, sufficient strength and range of motion criteria as per above mentioned Gazette notification is not being fulfilled by the examinee."

In respect of petitioner Sena Khokhar, the Medical Board

AIIMS, Jodhpur has reexamined her and given its opinion as

under:-

"On review examination by the Medical Board as per order of Hon'ble High Court dated 02.03.2022, ref.no. S.B. Civil Writ Petition No. 1543/2022, the candidate under examination was examined and observed to have a Permanent Physical Impairment of 40%(forty percent only) in relation to RIGHT UPPER LIMB which according to Gazette notification of India Part 3 Section IV (published 4th Feb. 2019) appendix H S.No.1 Subsection a(f) makes the candidate "INELIGIBLE" as Both Hands with intact sensation, sufficient strength and range of motion criteria as per above mentioned Gazette notification is not being fulfilled by the examinee."

In view of the above facts and circumstances of the case and

looking to the report of the Medical Board, AIIMS Jodhpur

regarding ineligibility of the petitioners, I am of the opinion that

the petitioners are not eligible for admission in the MBBS Course.

Hence, these writ petitions are dismissed.

The medical report submitted by AIIMS, Jodhpur be taken on

record.
