It is submitted by learned counsel for the petitioner that the

petitioner is governed by the provisions of Rajasthan Subordinate

Accounts Service Rules 1963, wherein the Appointing Authority of

the petitioner is Chief Accounts Officer, Rajasthan; however, the

order dated 04.03.2022 placing the petitioner under suspension

has been passed by the Secretary, Panchayati Raj Department,

who has no jurisdiction in terms of rule 13(1) of the Rajasthan

Civil Services (Classification, Control & Appeal) Rules 1958.

In view of the submissions made, issue notice of the petition.

Issue notice of stay application also.

Copy of the writ petition be served upon Mr Sunil Beniwal,

AAG to complete the instructions/file reply by the next week.

List the petition on 28.03.2022.

In the meanwhile and till further orders, the effect and

operation of the order dated 04.03.2022 (Annx.4) qua the

petitioner shall remain stayed.
