Relying on a Division Bench judgment of this Court dated
15.01.2018 in D.B. Civil Writ Petition No. 12076/2018:
Rajneesh Sharma V/s. State of Rajasthan & Ors., learned
counsel for the petitioners submitted that the Food Safety Officer
was not authorized to take the sample.
Issue notice of writ as well as stay application confined to
respondents No. 2 and 3. Rule is made returnable by five weeks.
Notices be filed in two sets. One set of notices be sent through
registered post with acknowledgment due. Steps to be taken
within a week.
Heard the learned counsel on interim relief.
Taking into consideration the contentions advanced by
learned counsel and the material on record, this Court deems it
just and proper to stay the operation and effect of order dated
30.03.2021 passed by Adjudicating Officer and Additional District
(2 of 2) [CW-11584/2021]
Magistrate, City East, Jaipur in case No. 50/2018, till further
orders.
