Appellant-plaintiff has preferred this first appeal assailing the
judgment and decree dated 19.09.2019 passed by Additional District
Judge No.1, Alwar in civil case No.34/123/2019, whereby and
whereunder his civil suit for cancellation of sale deed and permanent
injunction has been rejected under Order 7 Rule 11 CPC.
The appeal is delayed by 49 days for which an application under
Section 5 of the Limitation Act has been filed.
For reasons mentioned in the application supported with an
affidavit, the same is allowed. Delay in filing the appeal is condoned.
Heard on the appeal.
Admit.
Issue notice.
Learned counsel for appellant is directed to remove the defect in
relation to payment of deficit court fee within a period of four weeks.
