The present petition has been filed challenging the condition

of advertisement dated 29.04.2022 whereby it has been provided

that preference would be given to the local candidates in selection.

Learned counsel for the petitioner submits that in pursuance

to the advertisement the selection list has been issued and the

selected list of the EWS category shows that the candidates of the

other districts have also been selected whereas the list of OBC

candidates shows that the candidates belonging to Bikaner only

have been selected. Learned counsel submits that it is totally

discriminatory. Learned counsel further submits that the candidate

having as low as 68.24% marks has been selected whereas the

petitioner who is having 74.92% of marks has not been selected.

Learned counsel has relied upon a judgment of the Apex

Court rendered in Kailash Chand Sharma & Ors Vs. State of

Rajasthan & Ors reported in AIR 2002 SC 2877.

In view of the submissions made, issue notice. Issue notice

of the stay petition also. Notices be made returnable on

27.07.2022.

Meanwhile, one post of Nurse Grade-II qua the

advertisement in question shall be kept vacant.
