Learned counsel for petitioner submits that on the basis of

FIR No.194/2022 registered against the petitioner, the Police

Superintendent Anti Corruption Bureau has written a letter dated

08.06.2022 (Annexure-9) to the Commissioner Devasthan

Department, Rajasthan recommending for appointment of

administrator and seizure of the trust accounts.

Learned counsel for petitioner submits that as far as FIR is

concerned, the same is under challenge in the S.B. Criminal Misc.

Petition No.5196/2022 before the High Court and interim order for

not taking any coercive steps against the petitioner has been

passed therein. Learned counsel for the petitioner further submits

that Commissioner, Devasthan vide judgment dated 01.11.2021

has already passed an order to remove the stay on the withdrawal

from the bank accounts of trust. He further submits that the Police

Commissioner, ACB has no jurisdiction to instruct/ recommend the

Commissioner, Devasthan for appointment of administrator and

seizure of trust accounts and the letter dated 08.06.2022 is

arbitrary and without jurisdiction hence deserves to be quashed.

Heard.

Issue notice to respondents of writ petition as well as stay

application, returnable by 25.07.2022.

In the meanwhile, the operation of impugned letter dated

08.06.2022 and the consequential proceedings initiated in

pursuant thereof, if any, shall remain stayed.

Put up again on 25.07.2022.
