The respondent No.2 has lodged a case under Section 498A
IPC and other Sections of Indian Penal Code against her husband
Chotu Lal Kumawat. The trial resulted in acquittal vide judgment
dated 08.12.2021 passed in Case No.29/2015. A copy of the
judgment is at Annexure-3.
Thereafter, a decree of divorce was passed by the Competent
Court in favour of the husband of respondent No.2 against
respondent No.2 on 02.05.2022.
In the aforesaid background, FIR No.109/2022 registered
with Mahila Thana, Ajmer, has been challenged on the ground that
the petitioners being family members of husband, are being
maliciously prosecuted in the FIR for offences under Sections
498A, 406, 420 and 506 IPC.
Let notice should go to the respondent No.2 though both
processes.
Requisites be filed within ten days.

Learned Public Prosecutor accepts notice on behalf of the
State.
Meanwhile, petitioners shall not be arrested in the FIR under
challenge till further order with the condition that they shall fully
co-operate with the investigation of the case.
