For Petitioner(s) : Mr. Manish Kumar Sharma through V.C.

For Respondent(s) : Dr. Vibhuti Bhushan Sharma, AAG through V.C.

HON'BLE MR. JUSTICE SUDESH BANSAL

Order

05/01/2022 In the present contempt petition, non-compliance of final

judgment and order dated 02.12.2019 has been alleged by the

petitioner, whereby the petitioner was required to accord

appointment on the post of Constable (General) within a period of

10 days. However, till date the compliance has not been made,

therefore such inaction on the part of respondents is

contemptuous.

Counsel appearing for the respondents fairly admits that

though earlier S.B. Review Petition No.47/2020 was filed seeking

review of the order dated 02.12.2019, however, the review

petition has been dismissed vide order dated 23.11.2021.

Therefore, the respondents are in process of making the

compliance of the order. The counsel fairly admits that if a period

of four weeks is granted, appointment to the petitioner on the

(2 of 2) [CCP-915/2020]

post of Constable (General) would be accorded in compliance of

the order dated 02.12.2019.

Time prayed for is granted.

It is made clear that in case the compliance is not made as

assured hereinabove within the aforesaid period, the Additional

Director General of Police (Recruitment) shall furnish his

explanation with an affidavit and in case the compliance is not

made or the explanation is not found satisfactory, appropriate

orders on the contempt petition would be passed on the next date

of hearing.

Put up on 08.02.2022.

Today, the Court is working on virtual mode, therefore, the

personal appearance of the Officer In charge is dispensed with.
