These writ petitions have been filed by the petitioners
seeking a declaration that the petitioners are eligible and entitled
for appointment as Teacher Gr.III (Level-II) on the strength of
their graduation with subject concerned 'Additional'. Further prayer
has been made that the petitioners may be permitted to apply
pursuant to the recruitment notification dated 31.12.2021.
It is inter alia submitted by learned counsel for the
petitioners that the State has been permitting candidates having
qualification of graduation with additional subject, to apply and
have always held them eligible for the post of Teacher Gr.III
(Level-II).
Further submissions have been made that in the last
recruitment, the issue came up before this court in Dharmendra
Kumar Bhinchar & Ors. v. State of Rajasthan & Ors.: S.B. Civil
Writ Petition No.19113/2017 & other connected matters, which
writ petitions were directed against the inclusion of candidates like
petitioners in the recruitment. The said writ petitions came to be
allowed by order dated 21.8.2018.
D.B. Civil Special Appeal (Writ) No.1143/2018 (Pawan
Swaroop Gour & Ors. v. Dharmendra Kumar Bhinchar & Ors.)
came to be filed against the said judgment in the case of
Dharmendra Kumar Bhinchar (supra). State also filed appeal. The
Division Bench granted interim order. The candidates having
graduation with additional subject were accorded appointment by
the State. However, the Special Appeal filed by Pawan Swaroop

Gour (supra), State & other connected appeals came to be
dismissed by the Division Bench on 25.3.2021.
Against the judgment of learned Single Judge in Dharmendra
Kumar Bhinchar (supra) and Division Bench judgment in Pawan
Swaroop Gour (supra), Special Leave Petitions came to be filed by
Mukesh Kumar Meena & Ors. as well as State of Rajasthan.
In the Special Leave Petitions, Hon'ble Supreme Court on
17.9.2021 directed issuance of notice and ordered that pending
further consideration the effect and operation of the orders (s)
presently under challenge, shall remain stayed.
It is submitted that as the effect and operation of the
judgments of the learned Single Judge and Division Bench stands
stayed by the Hon'ble Supreme Court, it is not permissible for the
State now to exclude candidates like petitioners, who have done
their graduation with additional subject, from recruitment and hold
them ineligible.
Submissions have also been made that once the State itself
has questioned the validity of the orders, which have held the
candidates like petitioners as ineligible, during pendency of the
Special Leave Petitions, the State cannot go back on its decision in
this regard and as the State has already, during pendency of the
Special Appeal before the Division Bench, had granted
appointments, similar situation has arisen, wherein, the
judgments of learned Single Judge and Division Bench already
stands stayed by the Supreme Court.
Submissions have also been made that the non-inclusion of
petitioners at this stage when the Special Leave Petitions are
pending consideration, will make the situation irretrievable, in
case, the Special Leave Petitions are allowed by the Hon'ble

Supreme Court as the petitioners would be deprived of
opportunity to apply and/or consideration and, therefore, the
respondents be directed to permit the petitioners to apply
pursuant to the advertisement dated 31.12.2021.
Learned AAG, who appeared on caveat, made submissions
on the strength of the decision taken by the State and filed as
Annex.R/1. It was submitted that as the State has taken a
conscious decision to exclude the candidates like petitioners, they
are not entitled to be considered.
However, during course of submissions, it was fairly
conceded that the State has questioned the validity of the orders
passed by learned Single Judge in the case of Dharmendra Kumar
Bhinchar (supra) and Pawan Swaroop Gour (supra) by the Division
Bench before Hon'ble Supreme Court and that during pendency of
the Special Appeal before the Division Bench, on the strength of
the interim order passed by the Division Bench, the State had
gone ahead with according appointments to candidates having
qualification like the petitioners.
Mr. M.S. Godara, learned counsel has appeared on behalf of
newly added respondent and made submissions that the petitions
are not maintainable, inasmuch as, the petitioners have not
questioned the validity of the provisions prescribing the
qualification for appointment to the post of Teacher Gr.III (Level-
II) and as per the qualification as it stands in the Rules, the
petitioners are not qualified.
Further submissions have been made that, in case, any
interim relief is granted to the petitioners, it has to be ensured
that their applications are registered separately so as to ultimately

give effect to the judgment of Hon'ble Supreme Court, in case, the
Special Leave Petitions are dismissed.
I have considered the submissions made by learned counsel
for the parties and have perused the material available on record.
The stand of the State, from the previous recruitments, is
very clear that the candidates having graduation with additional
subjects are eligible for appointment to the post of Teacher Gr.III
(Level-II). When the challenge was laid to the inclusion in the
previous recruitment notification in the case of Dharmendra
Kumar Bhinchar (supra), State defended it and judgment was
delivered by learned Single Judge holding the candidates as
ineligible. The same was challenged by the State by filing Special
Appeal before the Division Bench and as the judgment of learned
Single Judge was stayed, the State went ahead and granted
appointments to the candidates having done graduation in
additional subject.
After the Division Bench dismissed the appeals, the State has
challenged the judgments before Hon'ble Supreme Court and in
Special Leave Petition filed by one Mukesh Kumar Meena (supra),
interim order has been granted by Hon'ble Supreme Court,
whereby, effect and operation of the orders, under challenge, have
been stayed.
For the reasons best known to the respondents, a decision
was taken by the Deputy Secretary, on a query made by the
Director, Primary Education, Bikaner, which decision was approved
by all the competent authorities including Minister concerned,
regarding inclusion of candidates having graduation with additional
subject. The decision arrived at, which has formed the basis for
excluding the candidates like petitioners reads as under:-

A perusal of the decision would indicate that the fact of State
having filed Special Leave Petition and the judgments having been
stayed by Hon'ble Supreme Court was noticed and thereafter with
reference to the two judgments, which are under challenge before
Hon'ble Supreme Court and referring to the dismissal of SLP in
Snehlata v. Delhi Government: SLP(C) No.26351/2013, decision
was taken to exclude the candidates having graduation with
additional subject.
Prima facie, the decision taken by the respondents on the
grounds indicated, as noticed hereinbefore, is apparently
erroneous, inasmuch as, they have ignored the fact that the effect
and operation of the judgments in the case of Dharmendra Kumar

Bhinchar (supra) and Pawan Swaroop Gour (supra) have been
stayed by Hon'ble Supreme Court, State's own stand during
pendency of Special Appeal based on the interim order passed by
the Division Bench and by placing reliance on dismissal of SLP in
the case of Snehlata (supra).
It is well settled that dismissal of an SLP against an order or
judgment of a lower forum is not an affirmation of the same. If
such an order of dismissal is non-speaking, it does not constitute
a declaration of law under Article 141 of the Constitution or attract
the doctrine of merger as laid down in the case of Kunhayammed
& Ors. v. State of Kerala & Anr.: (2000)6 SCC 359.
Apparently, the challenge to the inclusion of candidates
having graduation with additional subject is pending consideration
before Hon'ble Supreme Court and there is substance in the
submissions of learned counsel for the petitioners that at this
stage if the petitioners are excluded from applying for recruitment
and ultimately the Special Leave Petitions / Civil Appeals are
allowed, the situation and/or the status of the petitioners would be
irretrievable, whereas, in case they are permitted to apply
pursuant to the notification dated 31.12.2021, the same would not
affect anyone and if SLPs are dismissed, petitioners can be
excluded from further consideration.
So far as the submissions made by Mr. M.S. Godara
regarding the ineligibility of the candidates is concerned, as
already noticed, the issue is already at large before Hon'ble
Supreme Court and the final outcome of the present petitions as
well as the eligibility of the candidates like the petitioners, shall
depend upon the outcome of pending litigation before Hon'ble
Supreme Court.

In view of the above fact situation, wherein, the entire issue
is pending consideration before Hon'ble Supreme Court and as the
State has started the exercise of fresh recruitment for Teacher
Gr.III (Level-II), for the purpose of safeguarding the interest of
candidates like the petitioners, it would be in fitness of things that
the said candidates are permitted to fill up the forms pursuant to
the advertisement dated 31.12.2021.
In view of the above, admit. Issue notice. As State is
represented, no need to issue notices.
During pendency of the petitions, it is directed that the
respondents shall permit the candidates, who have done their
graduation with additional subject, to apply pursuant to the
advertisement dated 31.12.2021, subject to the final outcome of
the present writ petitions as well as the Special Leave Petitions
pending before Hon'ble Supreme Court.
As the online application forms do not provide for filing of the
applications by candidates, who have done their graduation with
additional subject, the State may do the needful in this regard so
as to provide opportunity to candidates like the petitioners, to
apply pursuant to the advertisement dated 31.12.2021.
It is further directed that the mechanism for filing
applications shall be provided in a manner that candidates, who
have done their graduation with additional subject, are grouped
separately from the other candidates, so as to give effect to the
judgments in the present writ petitions and/or the Special Leave
Petitions pending before Hoin'ble Supreme Court.
The State would be free to decide about the mechanism in
this regard as learned AAG made submissions that the applications
would have to be invited online only and for providing the said

facility, the software would be required to be updated / provided,
which will take some time.
The needful may be done by the respondents and adequate
opportunity be provided to the petitioners and all other similarly
placed candidates, who have done their graduation with additional
subject. It would not be required of those, who have not filed writ
petitions to approach this Court for the said purpose as the State
would not restrict any of the candidates by indicating that they
have not obtained interim orders from this Court.
Further, on the online applications to be filed by the
candidates itself, it would be specifically indicated that filing is
subject to decision in pending Special Leave Petitions before
Hon'ble Supreme Court.
Further response to the petitions, if any, may be filed within
a period of four weeks.
List the petitions after four weeks.
