On the last occasion learned counsel for the petitioner was
directed to place on record some documents to substantiate the
fact of initial date of appointment of her deceased husband as well
as the post on which he was initially appointed.
Today, it has been submitted on behalf of the petitioner that
the service record of her deceased husband is not in her
possession and she is not in a position to place on record any
document in compliance of the order dated 04.11.2022. The
submission of learned counsel for the petitioner has been that the
controversy is covered by the judgment as passed in the case of
Govind Dan Charan v. State of Rajasthan & Ors.; D.B. Civil
Special Appeal Writ No.1068/2014, decided on 17.12.2015.
In view of the above facts, learned counsel for the
respondents is directed to complete his instructions: firstly, as to
whether the matter is covered by Govind Dan Charan's case
(supra) or not and secondly, to ascertain the initial date of

appointment and post of the deceased husband of the petitioner
as he was an employee of the respondent Department.
List the matter on 16.12.2022.
