The delay of 149 days in filing the appeal since adequately
explained and the fact that the similar matters have already been
decided, we condone the delay in filing the appeal.

appearing for the appellants submits that an identical appeal (D.B.
Special Appeal Writ No.784/2022 : State of Rajasthan & Ors.
Vs. Rais Mohammad) has already been disposed of vide
judgment and order dated 30.09.2022, therefore, he submits that

the present appeal may also be decided in terms of the above
decision.
In view of the aforesaid facts and circumstances, the present
appeal also stands disposed of on the same terms and conditions
as in the above referred decision.
