Learned counsel for the respondents Mr. Aatish Jain submits

that this Court in S.B. Civil Writ Petition No.2709/1999 decided on

08.02.2013 has held that if a lease deed has been issued in favour

of any person and the same is put to challenge, the Arbitrator has

power under Section 75 of the Rajasthan Cooperative Societies

Act, 1965 to set aside such lease deed.

Learned counsel for the petitioner Mr.Shiv Charan Gupta

wants to go through the said judgment and also to go through the

relevant case law on the issue involved.

Learned counsel for the respondents Mr.Aatish Jain submits

that though record of Cooperative Tribunal has been received,

however, record of Arbitrator is also necessary for adjudication of

the matter.

Learned counsel for the respondents Mr.Aatish Jain, may be

given requisition for summoning the record of the Arbitrator.

List the matter on 13.09.2022.
