3. Commissioner, Nagar Nigam, Udaipur (Raj.)

4. Secretary, Urban Improvement Trust, Udaipur (Raj.)

----Respondents

Judgment

26/10/2021

1. By way of present writ petition, the petitioner has challenged

the action of the respondents, who according to the

petitioner, are trying to dispossess the petitioner by

removing the construction.

2. The petitioner has simply prayed that in SBCFA No.111/1998

(Ratan Singh Kumawat Vs.UIT, Udaipur) this Court has

passed an interim order on 20.05.1998 in favour of appellant

therein and thus, similar order be passed in the present writ

petition also.

(2 of 2) [CW-842/2020]

3. In the opinion of this Court, since the petitioner has not

shown any title or right in his favour, no relief can be

granted.

4. So far as the order dated 20.5.1998 passed by this Court is

concerned, the petitioner has not even placed a copy of the

order dated 20.5.1998, on which the petitioner has placed

heavy reliance. That apart, the same appears to have been

passed in a first appeal (SBCFA No.111/1998).

5. This Court finds no merit and substance in the present writ

petition, for which, it is hereby dismissed.

6. Needless to observe that the petitioner shall be free to avail

remedies available to him under law.

7. The stay application also stands disposed of accordingly.
