     In wake of second surge in the COVID-19 cases, abundant

caution is being maintained, while hearing the matters in Court,

for the safety of all concerned.

     Learned counsel for the petitioner has relied upon the

judgment rendered by this Hon'ble Court in Vijay Saraswat Vs.

State of Rajasthan & Ors. reported in 2007 Raj CANDID 463,

whereby strength of which, learned counsel for the petitioner

                                   submits that the petitioner's consent was not there with the

                                   deputation.

                                        Issue notice.

                                        Learned counsel Mr.Deepesh Beniwal accepts notice on

                                   behalf of the respondents no.1 to 4. He seeks some time to

                                   complete his instructions.

                                        Issue notice to the respondent no.5, returnable in four

                                   weeks.

                                        In the meanwhile, effect and operation of the order dated

                                   15.09.2021 qua the petitioner shall remain stayed.
