     In wake of second surge in the COVID-19 cases, abundant

caution is being maintained, while hearing the matters in Court,

for the safety of all concerned.

     Learned counsel for the petitioner submits that the petitioner

is to retire on 31.3..2022, which is less than two years.

     Learned counsel for the petitioner has relied upon the

judgment of Pushpa Mehta v. Rajasthan Civil Services

Appellate Tribunal & Ors. (reported in RLW 2000(1) (Raj.)

233) decided on 16.12.1999.

     Learned counsel for the petitioner has also relied upon the

judgment of this Court passed in S.B. Civil Writ Petition

                                   No.11111/2020; Karni Singh Vs. State of Rajasthan & Ors.,

                                   decided on 24.03.2021.

                                        Issue notice to the respondents.

                                        Since learned counsel is already appearing on behalf of the

                                   respondents no.1 to 4, therefore, no need to issue notices to

                                   respondents no.1 to 4. He seeks some time to complete the

                                   instructions.

                                        Time prayed for is allowed.

                                        List after four weeks.

                                        In the meanwhile, effect and operation of the order dated

                                   29.09.2021 shall remain stayed qua the petitioner.
