     In wake of second surge in the COVID-19 cases, abundant

caution is being maintained, while hearing the matters in Court,

for the safety of all concerned.

     Learned counsel for the petitioner submits that the petitioner

is stipulated to retire on 30.04.2022.

                                        Learned counsel for the petitioner has relied upon the

                                   judgment of Dr. Pushpa Mehta v. Rajasthan Civil Services

                                   Appellate Tribunal & Ors. (reported in RLW 2000(1) (Raj.)

                                   233) decided on 16.12.1999.

                                        Issue notice to the respondents.

                                        Mr. Mahesh Vishnoi, learned counsel for the respondents is

                                   directed to accept notice on behalf of the respondents, which he

                                   accepts and seeks some time to complete his instructions.

                                        Time prayed for is allowed.

                                        List after four weeks.

                                        In the meanwhile, effect and operation of the order dated

                                   30.09.2021 (Annex.4) and relieving order dated 01.10.2021

                                   (Annex.5) qua the petitioner, shall remain stayed.
