     In wake of second surge in the COVID-19 cases, abundant

caution is being maintained, while hearing the matters in Court,

for the safety of all concerned.

     Learned counsel for the petitioner submits that the petitioner

is stipulated to retire on 10.07.2023.

     Learned counsel for the petitioner has relied upon the

judgment of Dr. Pushpa Mehta v. Rajasthan Civil Services

                                   Appellate Tribunal & Ors. (reported in RLW 2000(1) (Raj.)

                                   233) decided on 16.12.1999.

                                        Issue notice to the respondents.

                                        Mr. Vishal Jangid appearing for Mr. Hemant Choudhary,

                                   learned Government Counsel is directed to accept notice on behalf

                                   of the respondents No.1 to 4, which he accepts and seeks some

                                   time to complete his instructions.

                                        Let the notice be issued to respondent no.5 only, returnable

                                   within four weeks.

                                        In the meanwhile, effect and operation of the order dated

                                   29.09.2021 (Annex.1) qua the petitioner, shall remain stayed.
