       In wake of second surge in the COVID-19 cases, abundant

caution is being maintained, while hearing the matters in Court,

for the safety of all concerned.

       Learned counsel for the petitioner submits that the petitioner

is going to superannuate on 31.01.2023. He relied upon the

judgment of Pushpa Mehta Vs. Rajasthan Civil Services

Appellate Tribunal & Ors., reported in RLW 2000(1) (Raj.)

233.

       Issue notice.

                                        Mr. Deepesh Singh Beniwal, learned counsel is directed to

                                   accept notice on behalf of the respondents, which he accepts.

                                   Hence, service is complete. He seeks some time to complete his

                                   instructions.

                                        Time prayed for is allowed.

                                        List the matter after four weeks.

                                        In the meanwhile, effect and operation of the orders dated

                                   30.09.2021 (Annex.2) qua the petitioner shall remain stayed.

                                        It is needless to say that the respondents shall be at liberty

                                   to pray for vacation of stay.
