     In wake of second surge in the COVID-19 cases, abundant

caution is being maintained, while hearing the matters in Court,

for the safety of all concerned.

     Learned counsel for the petitioner has shown the seniority

list, which is reflected in the order dated 26.03.2021 (Annex.7), in

which, the petitioner's name stands at serial no.2 being appointee

of 06.11.1997 and the name of private respondent stands                           at

serial no.6 being appointee of 01.12.1998.

                                        Learned counsel for the petitioner further submits that the

                                   petitioner was given charge of Managing Director, Dugdh Sangh,

                                   Pali vide order dated 02.08.2021. He further submits that the

                                   respondent no.4 being a junior person has now been placed on the

                                   same post vide order dated 30.09.2021 (Annex.8).

                                        Learned counsel for the petitioner has relied upon the

                                   judgment of Jaipur Bench of this Court in Devi Singh Bhati Vs.

                                   State of Rajasthan & Ors. reported in (2011) 3 RLW 2762.

                                        Issue notice to the respondents, returnable within a period of

                                   four weeks.

                                        In the meanwhile, effect and operation of the order dated

                                   30.09.2021 (Annex.8) qua the respondent no.4 shall remain

                                   stayed.
