     In wake of second surge in the COVID-19 cases, abundant

caution is being maintained, while hearing the matters in Court,

for the safety of all concerned.

     Learned counsel for the petitioner submits that the petitioner

is holding the post of Lecturer and is going to retire on

31.05.2023, which is less than two years.

     Learned counsel for the petitioner has relied upon the

judgment of Pushpa Mehta v. Rajasthan Civil Services

                                   Appellate Tribunal & Ors. (reported in RLW 2000(1) (Raj.)

                                   233) decided on 16.12.1999.

                                         Learned counsel for the petitioner has also relied upon the

                                   judgment of this Court passed in S.B. Civil Writ Petition

                                   No.11111/2020; Karni Singh Vs. State of Rajasthan & Ors.,

                                   decided on 24.03.2021.

                                         Issue notice to the respondents.

                                         Since Counsel      is   already appearing on behalf of the

                                   respondents, therefore, no need to issue notices to respondents.

                                         Learned counsel for the respondent no.4 seeks some time to

                                   file reply to the writ petition.

                                         Time prayed for is allowed.

                                         List after four weeks.

                                         In the meanwhile, effect and operation of the order dated

                                   29.09.2021 (P/2) and order dated 25.09.2021 (P/4) shall remain

                                   stayed qua the petitioner.
