Learned counsel appearing for the appellant submits that the

controversy involved in the present appeal stands covered by the

decision of Hon'ble the Supreme Court in the case of Ranjana

Kumari Vs. State of Uttarakhand & Ors. [Civil Appeal

Nos.8425 of 2013] decided on 01.11.2018.

and, therefore, the in the light of said judgment, the present

special appeal deserves to be dismissed.

Accordingly, the present special appeal is dismissed in the

light of decision of the Apex Court in the case of Ranjana Kumari

(supra).
