Counsel for the petitioner submits that right to submit the

evidence has been closed by the learned Trial Court without giving

proper opportunity to submit his evidence. In support of his

contention, counsel relied upon a judgment passed by the Hon'ble

Allahabad High Court in the matter of Pt. Gopi Charan Bajpai &

Ors. Vs. Pt. Ram Prasad Awasthi & Ors., reported in AIR 1957

Allahabad 283.

In that view of the matter, issue notice to the respondents,

returnable by six weeks.

Meanwhile, the learned Trial Court is directed not to pass the

final order/judgment.
