An application seeking impleadment as party-respondents

has been filed by one Ramgopal Kumawat and nine others.

In support of this prayer, it is submitted that the proposed

applicants are those who are in valid occupation/possession of the

(2 of 2) [CCP-135/2020]

land in their title and ownership and their names have been duly

recorded in the records of rights and without hearing them, orders

were passed by the Division Bench earlier, out of which contempt

petition has been filed.

If that be so, the remedy available to the applicants is to file

appropriate independent proceedings or to seek

modification/recall of order so passed. The Application No.01/2021

being misconceived is rejected, however, with liberty to take

appropriate proceedings.

Learned state Counsel is granted three days time to file

counter affidavit to satisfy the Court for steps which have been

taken towards compliance of the order passed by this Court.

Matter be listed in the next week.
