Learned Public Prosecutor submits that as per the factual

report, the charge sheet has been filed against the petitioner.

The factual report produced by learned Public Prosecutor is

taken on record.

In view of the factual report received, learned counsel for the

petitioner does not want to press this petition, however, he seeks

liberty to take appropriate proceedings before the trial court.

Accordingly, the misc. petition is dismissed as not pressed

with liberty as aforesaid.

Learned Public Prosecutor submits that the Investigating

Agency has not found the allegation substantiated against the

present petitioner and therefore, negative final report is being filed

in his case.

In view of the factual report, nothing survives in this

petition.

Accordingly, the misc. petition is dismissed as having become

infructuous.
