The matter comes up for orders on an application
preferred by the complainant for releasing the gold articles, cash
amount to the tune of Rs.93,600/- and four keys recovered from
the accused appellant during the course of investigation.
By the impugned judgment dated 11.12.2019, the
accused appellant Champalal was convicted and sentenced to
undergo life imprisonment. The trial court has already directed
that the valuables, i.e. gold ornaments and the cash shall be
returned to the complainant Sakharam (P.W.3) after the limitation
for appeal is over.
It may be mentioned here that the appellant Champalal
also filed an appeal under Section 454 CrPC for challenging the
direction given by the trial court to return the valuables to the
complainant, but the said appeal has been dismissed vide order
dated 09.09.2021. Thus, there is no impediment in directing

return of these articles to the complainant. Accordingly, the
Registry is directed to return the original record to the trial court,
who shall, after due verification, hand over the gold ornaments
and cash amount to the complainant Sakharam. Immediately
after this process is completed, the record be sent back to this
court. The application is allowed, accordingly.
