An application under Section 151 CPC has been filed by the

respondent No.4 seeking a direction against the respondent

No.56, the District Collector, Nagaur for passing order for

conversion of the land in question.

It is inter-alia submitted in the application that the suit filed

by the appellant has been dismissed by the trial court by its

judgment dated 16.09.2019 under Order VII Rule 11 CPC.

Feeling aggrieved, the present first appeal has been filed,

wherein, this Court by order dated 18.11.2019 ordered as under:-

"Meanwhile and till the next date of hearing, any use of land[conversion/alienation] will remain subject to final outcome of this appeal."

It is submitted that the respondent No.4 has approached the

authorities seeking conversion of the land in question, which has

been recommended by the SDO, Riya Badi (Nagaur). However, the

District Collector, by misinterpreting the order dated 18.11.2019

(supra) has not passed any order and, therefore, he may be

directed to pass the order for conversion as the interim order

granted is very clear, wherein, the passing of order for conversion

and/or alienation has not been stayed, the same have only been

made subject to the outcome of the appeal.

Further submissions have been made that the appellant by

filing application before Tehsildar, has claimed that there is interim

order of this Court, which is distortion of the order dated

18.11.2019 passed by this Court.

Learned counsel for the appellant made submissions that the

prayer made by the respondents seeking direction to the District

Collector to pass the order for conversion is beyond the scope of

the present proceedings and it is for the District Collector to take a

view on the application filed by the respondent No.4 seeking

conversion of the land. So far as the order passed by this Court is

concerned the same is very specific and, therefore, the application

filed by the respondent deserves to be dismissed.

I have considered the submissions made by learned counsel

for the parties and have perused the material indicated in the

application as well as order passed by this Court.

The order dated 18.11.2019 passed by this Court, is very

clear, wherein, it has been indicated that 'use of land', which has

been further specified by indicating 'conversion/alienation', would

remain subject to the final outcome of the appeal and, therefore,

the respondent No.4 to the extent of submissions that there is no

interim order by this Court qua the conversion/alienation, are

correct. However, insofar as, passing of order of conversion is

concerned, it is for the District Collector to take a view as to

whether the order for conversion should be passed or not, there is

no occasion for this Court to direct him to pass order for

conversion. However, the Collector cannot sit on the application,

he has to pass an order, either way.

In view of the above, the application filed by the respondent

No.4 is disposed of.

The District Collector may pass appropriate orders on the

application for conversion in accordance with law, expeditiously.
