Learned counsel for the petitioner apologetically submits that

though the matter was disposed of at petitioner's instance, while

placing reliance upon the judgment of this Court rendered in the

case of Chandrabhan Vs. State of of Raj. (S.B. Civil Writ Petition

No.9785/2013), however, the fact that para No.2 and 3 of the

judgment aforesaid are not relevant for the present purposes,

could not be brought to the notice of the Court.

In view of the aforesaid, the order dated 21.01.2021 is

hereby recalled.

List this case tomorrow i.e. 10.03.2021.
