The petitioner has approached this Court by way of this

criminal misc. petition under Section 482 Cr.P.C. seeking to assail

the order dated 14.09.2017 passed by learned Judicial Magistrate,

First Class, Pachpadra, District Barmer in Criminal Case

No.758/2015 whereby the application filed by the petitioner under

Section 311 Cr.P.C. was rejected.

Apparently, the misc. petition came to be submitted after

more than one and a half years of the order being passed.

As per the telephonic information received from the trial

court, the parties seems to have entered into a compromise. No

one has appeared on behalf of the petitioner to argue the petition

even in second round.

Thus, the misc. petition as well as the stay application are

dismissed for want of prosecution.
