The petitioners apprehend their arrest in connection with FIR

No.183/2019 of Police Station Sadar Barmer, for the offences

punishable under Sections 323, 341, 327, 325 and 329/34 IPC.

They have preferred this anticipatory bail application under

Section 438 Cr.P.C.

The complainant- Revat Singh filed this FIR at Police

Station Sadar Barmer alleging that the petitioners along with

other co-accused persons assaulted his brothers Sawai Singh as

well as Jai Singh when they were purchasing something from a

shop at Saran Bus Stand. During the course of investigation, the

police recorded statements of complainant and the injured

persons-Sawai Singh and Jai Singh and the said witnesses have

reiterated that they were assaulted by the petitioners along with

the other co-accused persons. The medical examinations of the

complainant and injured persons have also been conducted

wherein the injuries on the body of them have also been found.

Having gone through the case diary, without expressing any

opinion on the merits of the case, I am not inclined to grant

anticipatory bail under Section 438 Cr.P.C. to the petitioners.

Accordingly, the application preferred by the petitioners

under Section 438 Cr.P.C. is rejected.
