In the wake of second surge in the COVID-19 cases, the

Court is functioning virtually and abundant caution is being

maintained for the safety of all concerned.

Counsel for the petitioner points out that the application for

transfer of petitioner to Open Air Camp has been rejected by the

respondents without taking into consideration the judgments

passed by this Court in the matter of Narendra Singh @

Mukesh @ Bhura Vs. State of Rajasthan & Ors (D.B. Criminal

Writ Petition No.506/2020, decided on 22.01.2021) and Amin

(2 of 2) [CRLW-154/2021]

Khan @ Aamin Khan Vs. State of Rajasthan & Ors (D.B.

Criminal Writ Petition No.176/2018, decided on 31.5.2018).

On such limited submission, the present criminal writ petition

is disposed of while directing the respondents to re-consider the

prayer for transfer of petitioner to Open Air Camp while keeping

into consideration judgments aforesaid as per existing law within a

period of one month from today.
