Counsel for the petitioner submitted that petitioner had

applied for admission in Ph.D. (Ayurveda) (Ayurveda Samhita

evam Siddhant) Programme for Academic Session 2021-22 in

physical challenged (PH) category.

Counsel submitted that initially the respondent-university

had decided to conduct the written examination but however, later

on the process of admission was changed and the respondents

conducted an online interview through video conferencing.

Counsel further submitted that petitioner participated in the

newly adopted procedure, however in the final result petitioner is

not found suitable for admission against PH category seat.

Counsel submitted that selection based on 100% interview is

not the correct procedure for making selection and the same is

arbitrary. Counsel refers to a judgment passed by the Delhi High

Court in WP(C) 3032/2017 [Students Federation of India & Ors Vs.

Union of India & Ors].

Counsel for the petitioner submits that out of two seat in

Maulik Siddhanta, one person from OBC category has been

selected and in PH category, no person was found to be suitable

but a wait list of the OBC category has been published.

Issue notice of the writ petition as well as stay application,

returnable on 19.07.2021. Additional copy of the writ petition may

be served in the office of Mr. Anurag Agarwal.

In the meanwhile, if respondents have not already allotted

admission till date in subject Maulik Siddhanta against PH

category, they will not further fill any seat till further orders.
