This matter has come-up on an application (IA No.725/2021)
under Section 5 of the Limitation Act.
It has been submitted on behalf of learned counsel for the
appellant that there is a certain delay in filing of this appeal which
is not intentional but due to the reason that younger brother of
the appellant had died during the pendency of appeal and legal
heirs of his brother did not show any interest in further pursuing
the matter. Apart from it, the appellant also failed to contact the
counsel due to effect of COVID-19. As soon as the situation
became normal, the appellant contacted the counsel and obtained
the copies of judgments/decrees. Hence, the delay in filing the
appeal may be codoned.
In view of the submissions, the application (IA No.725/2021)
is allowed and delay in filing the appeal is condoned.
Office to proceed further.
List after two weeks.
