1. Petitioner has filed this bail application under Section 439

Cr.P.C.

2. F.I.R. No.75/2019 was registered at Police Station Dabi for

offence under Section 302 I.P.C.

3. It is contended by counsel for the petitioner that there are

discrepancies in the statement of witnesses.

4. Learned Public Prosecutor has opposed the bail application. It

is contended that there is a child witness who has seen the

petitioner committing the offence. It is also contended that blood

stained clothes and an axe have been recovered at the instance of

the petitioner. It is further contended that the matter is at final

stage.

5. I have considered the contentions.

6. Considering the contentions put forth by counsel for the

State, I am not inclined to entertain the bail application.

7. This bail application is, accordingly, dismissed.

8. Trial Court is directed to expedite the disposal of the case.
