1. A reply to the contempt petition has been filed.

2. Mr. Kunal Upadhayay, learned counsel for the respondents,

tried to impress upon the Court that the petitioner was not eligible

as per the NCTE norms.

3. In opinion of this Court, the order under consideration (dated

22.11.2017), allowing petitioner's writ petition, was passed in the

presence of respondents.

4. While hearing a contempt petition, neither can this Court

examine the correctness of the judgment passed by this Court,

nor can respondents be permitted to find fault in the same.

5. This Court finds a clear non-compliance of the order dated

22.11.2017 passed by this Court, the respondents are prima-facie

guilty of contempt.

6. It is a matter of great concern that inspite of the judgment

passed way back on 22.11.2017, the respondents have neither

given appointment to the petitioner nor have they shown any

order of the higher forum.

7. List the matter on 27.08.2021, by which date if no

appointment order is issued to the petitioner, the Chief Executive

Officer - present incumbent in the Office of Chief Executive Officer,

Zila Parishad, Jodhpur, shall remain present before this Court.
