This bail application has been filed under Section 439 Cr.P.C.

in connection with FIR No.216/2021 registered at Police Station

Subhashnagar, Distt. Bhilwara for offence under Section(s) 323,

324, 307 IPC and Section 75 of Juvenile Justice (Care and

Protection of Child) Act.

Heard learned counsel for the petitioner as well as learned

Public Prosecutor and perused the entire material available on

record.

Learned counsel for the petitioner submits that petitioner's

mother expired yesterday.

Learned Public Prosecutor has opposed the bail application.

Keeping in view the nature of allegation where there is

dispute between husband and wife and taking into consideration

the overall facts and circumstances of the case, but without

commenting on merits of the case, I deem it just and proper to

enlarge the petitioner on bail.

Therefore, this bail application is allowed and it is ordered

that the accused petitioner Jagdish Chandra S/o Bardi Chand, be

released on bail under Section 439 Cr.P.C. in connection with

aforesaid FIR provided the petitioner furnishes a personal bond of

Rs.50,000/- with one surety in the like amount to the satisfaction

of the concerned Magistrate with the stipulation that he shall

comply with all the conditions laid down under Section 437(3)

Cr.P.C.
