Criminal Miscellaneous II Bail Application No.7695/2021 :

Bhanwar Singh @ Bharat Singh versus State of Rajasthan

and held that the bail application under Section 439 Cr.P.C. would

not lie against an order passed by the learned Court below

rejecting application under Section 167 (2) of Cr.P.C.

In view thereof, learned counsel for the petitioner prays for

converting this bail application to Criminal Revision Petition.

Registry is accordingly directed to register this bail

application as Criminal Revision Petition and place it before the

roster concerned.

List this case again in the next week.
