This bail application has been filed under Section 439 Cr.P.C.

in connection with FIR No.90/2021 registered at Police Station,

Sedwa, District Barmer for offence under Section(s) 8/21 & 29 of

the NDPS Act.

Heard learned counsel for the petitioners as well as learned

Public Prosecutor and perused the entire material available on

record.

Learned counsel for the petitioners submits that the recovery

has not been made from the petitioners and the quantity of smack

actually recovered from another person is only 6 gms while small

quantity is 5 gms.

Learned Public Prosecutor has opposed the bail application.

Taking into consideration the aforesaid aspects but without

commenting further on merits of the case, I deem it just and

proper to enlarge the petitioners on bail.

Therefore, this bail application is allowed and it is ordered

that the accused-petitioners - (1) Budh Ram [email protected] Budhra

Ram S/o Nena Ram, & (2) Naresh Kumar S/o Bhakhra Ram

be released on bail under Section 439 Cr.P.C. in connection with

aforesaid FIR provided each of them furnishes a personal bond of

Rs.20,000/- with one surety each in the like amount to the

satisfaction of the concerned Magistrate with the stipulation that

they shall comply with all the conditions laid down under Section

437(3) Cr.P.C.
