In D.B. Civil Special Appeal Writ No. 855/2019:-

Appellants have filed the appeal challenging the order dated

05.12.2018 passed by the learned Single Judge, whereby, writ

petition filed by the respondent, was allowed.

Learned State Counsel has very fairly conceded that the

appeal deserves to be dismissed in view of the order passed by

the Hon'ble Supreme Court in Special Leave Petition (Civil)

Nos. 25492-25495/2019 titled as Rajesh Kumar ETC. Vs.

State of Rajasthan & Ors. decided on 24.01.2020, wherein, a

similar order passed by the learned Single Judge of this Court was

upheld.

Dismissed.
