This bail application has been filed by the petitioner under

Section 439 Cr.P.C. in connection with CR No.83/2021 registered

at Police Station, Merta City, District Nagaur for offence under

Section 8/21 NDPS Act.

Heard learned counsel for the petitioner as well as learned

Public Prosecutor and perused the entire material available on

record.

Looking that the total quantity of the contraband Codeine as

10 mg in each bottle and total 110 bottles were recovered, which

comes to 11 gms while the minimum quantity allowed is 10 gms;

without commenting on merits of the case, I am inclined to

release the petitioner on bail.

Accordingly, this bail application is allowed and it is ordered

that the accused petitioner - Toda Ram s/o Nand Kishore be

released on bail under Section 439 Cr.P.C. in connection with

aforesaid CR No.83/2021 registered at Police Station, Merta City,

District Nagaur provided the petitioner furnishes a personal bond

of Rs.50,000/- with one surety in the like amount, to the

satisfaction of the concerned Magistrate with the stipulation that

he shall comply with all the conditions laid down under Section

437 (3) CrPC.
