This criminal miscellaneous petition under Section 482 Cr.P.C.

has been filed with a prayer to quash the FIR No.702/2019 dated

31.07.2019 registered at Police Station Shipra Path, District Jaipur

City (South) for offence under Sections 143, 452, 354, 323, 408,

504 & 506 of I.P.C.

Learned counsel submitted that minor dispute between the

parties gave rise to the present FIR against him and cross FIR

No.701/2019 against the complainant party. Relying on the

compromise dated 26.11.2019, he submitted that now the dispute

has amicably been settled between the parties and prayed for

quashing the FIR in question. Learned counsel relied on the

judgments of the Hon'ble Apex Court of India in cases of Gian

Singh versus State of Punjab & Anr. reported in JT 2012 (9)

SC-426 & Narinder Singh & Ors. versus State of Punjab &

Anr. reported in 2014 Cr.L.R. (SC) 351 in support of his

contentions.

Learned Public Prosecutor opposed the criminal

miscellaneous petition.

Learned counsel appearing for the complainant

acknowledging the factum of compromise between the parties,

submitted that he has no objection if the FIR in question is

quashed.

Heard learned counsel for the parties and perused the

record.

Since, the dispute between the parties not involving any

heinous offence, has already been settled amicably, in view of the

law laid down by the Hon'ble Apex Court of India in cases of Gian

Singh (supra) & Narinder Singh (supra), this Court deems it

just and proper to quash the FIR in question on the basis of

compromise between the parties.

Resultantly, this criminal miscellaneous petition is allowed.

The FIR No.702/2019 dated 31.07.2019 registered at Police

Station Shipra Path, District Jaipur City (South) for offence under

Sections 143, 452, 354, 323, 408, 504 & 506 of I.P.C. is quashed.
