Order
15/01/2021 Learned counsel for the petitioner submits that the petitioner
assailed her transfer order before the Rajasthan Civil Services
Appellate Tribunal by preferring an appeal bearing No.1737/2020.
However, the Tribunal while noticing the contention of the
petitioner has failed to examine the case on merits and simply
quoted one judgment of the Supreme Court and without attending
to the merits of the case, proceeded to dismiss the appeal.
Learned counsel submits that petitioner has been blessed
with the child after six months back in June, 2020 and her
husband is also posted in another District and in such tender age
of her child, she joined duties on account of excess of work
without even availing complete maternity leave. However, in spite
of such a situation, she has been posted in order to adjust
respondent.
Issue notice of the writ petition as well as the stay
application, returnable within four weeks.

In the meanwhile, the petitioner shall be allowed to perform
her duties at Jhunjhunu in the Office of Mining Engineer,
Jhunjhunu till further orders.
