After attempting to argue the matter on merits for quite

some time, learned counsel for the petitioner has submitted that

that he does not want to press this bail application, however,

seeks liberty for the petitioner to file fresh application before the

trial court after recording of the statements of injured Manoj.

In view of the above, this criminal misc. bail application

preferred by the petitioner under Section 439 Cr.P.C. is dismissed

as not pressed with the aforesaid liberty.

However, it is expected that the trial court shall record the

statements of injured Manoj on priority basis.
