At the outset, counsel for the petitioner has made a limited

prayer that the writ petition may be disposed of with the direction

that if the petitioner files a detailed representation ventilating his

grievances before the respondent No.3 i.e. Sub Divisional Officer-

Cum-Land Acquisition Officer, Nagour, the same shall be

considered and decided by the respondent No.3 on merit.

Learned counsel for the respondents submits that a joint

inspection regarding width of the road is required to be done in

the presence of officials of Public Works Department.

In view of submissions made by counsel for the parties, the

present writ petition is disposed of with the direction that if the

petitioner submits a fresh detailed representation ventilating his

grievances before the respondent No.3 within a period of two

weeks from today, the respondent No.3 shall decide the same on

merits after making proper inspection of the land in question

within a period of four weeks thereafter. However, the petitioner

shall be at liberty to file a fresh writ petition before this Court, if

any necessity arises.

Stay Petition is also disposed of.
