This is the second application for SOS filed on behalf of the

appellant-applicant.

Learned Public Prosecutor has chosen not to file reply to this

application for suspension of sentence and proposes to argue the

matter orally.

Heard learned counsel Shri Bishnoi representing the

applicant appellant, learned Public Prosecutor and learned counsel

Mr. Acharya representing the complainant. Perused the impugned

judgment and the material available on record.

There is a distinct allegation of the prosecution witnesses

that the appellant-applicant inflicted repeated blows to the

deceased - Shayar Ram. Multiple injuries were noticed on the

head of Shayar Ram when the postmortem was conducted. In this

background, we are not inclined to accept the instant second

application for SOS filed on behalf of the appellant-applicant which

is dismissed as being devoid of merit.

The appeal shall be listed for hearing in the suitable order of

priority.
