Heard learned counsel for the appellants.

It has been submitted that a civil suit for specific

performance and permanent injunction was filed in the learned

trial Court, which was decided on 29.8.2016. By this judgment,

learned trial Court decreed the suit in favour of the plaintiffs.

Against this judgment, first appeal was filed, which was decided

on 06.12.2019. The appeal was allowed and judgment and decree

of the trial Court was set aside and plaintiffs' suit was dismissed.

Against this, second appeal has been filed. Counsel has placed

reliance on order dated 04.09.2020 passed by the co-ordinate

Bench of this Court in S.B. Civil Second Appeal No.52/2020.

Issue notice of the appeal as well as stay application,

returnable within four weeks. As to why, this appeal shall not be

admitted on the legal grounds mentioned in the memo of the

appeal.

Necessary steps be taken within one week.

In the meanwhile, the respondents are directed not to create

third party rights in disputed property.
