Order

17/12/2021

This appeal is filed against the judgment of the learned

Single Judge dated 22.09.2021. The Petitioner claims to have

contacted marriage with Jagdish Prasad Sharma. Such marriage is

also registered with the marriage registration authority. Jagdish

Prasad later expired on 04.02.2021. It appears that family

members of Jagdish Prasad have disputed this marriage and also

requested for cancellation of the registration of marriage. Marriage

registrar thereupon passed an order on 11.02.2021 and

(2 of 2) [SAW-896/2021]

suspended the registration pending further enquiry. Petitioner filed

an appeal against such order which was dismissed on 25.08.2021.

Learned Single Judge also dismissed the petition observing that

family members have alleged that Jagdish Prasad was in coma for

the period between 17.12.2020 to 04.02.2021 when expired. That

being the position the factum of alleged marriage was seriously

doubted. We do not find any reason to interfere. The order passed

by the marriage registrar is only an interim measure.

The appeal is dismissed.
