This matter has come up on an application (IA

No.1/2021).

It has been submitted that the appellant-Om Prakash

Verma has filed this appeal before the Court challenging the

judgment passed by the learned trial court, by which, he was

convicted and sentenced during the pendency of the appeal. The

original appellant-Om Prakash Verma has died on 27.04.2021. The

applicant is the wife of the original appellant- Om Prakash Verma

and is filing the present application seeking leave of this Hon'ble

Court to continue the proceedings of the appeal. On account of

conviction of the original appellant, applicant failed to receive

death cum retiral benefits of her husband, hence continuation of

this appeal is necessary for final adjudication of the case on

merits. Therefore, under provisions of Section 394 of Cr.P.C., the

application may be allowed to continue the proceedings of the

appeal.

In view of the submissions, the application is allowed.

Learned counsel for appellant is directed to place on

record the amended cause title.
